Cannabis law in Canada
On October 17, 2018, cannabis was legalized in Canada for recreational and medical purposes. It was already legal for medicinal purposes, under conditions outlined in the Marihuana for Medical Purposes Regulations issued by Health Canada, and for seed, grain, and fibre production under licence by Health Canada.
The legalization for recreational purposes was achieved with the passage of Bill C-45, the Cannabis Act by Parliament on 19 June 2018. Legalization was effective on October 30, 2018. Persons aged 18 or older can possess up to 30 grams of dried or “equivalent non-dried form” in public. Adults are also allowed to make cannabis-infused food and drinks “as long as organic solvents are not used to create concentrated products.
Minimum age
In Canada, each province and territory sets the minimum age for cannabis use. Currently, it is 18 in Alberta, 21 in Quebec, and 19 in every other province or territory. It remains prohibited for underage individuals to access cannabis — or for adults to facilitate access.
Possession limits for cannabis products
The possession limits in the Cannabis Act are based on dried cannabis. Equivalents were developed for other cannabis products to identify what their possession limit would be.
One (1) gram of dried cannabis is equal to:
5 grams of fresh cannabis
15 grams of edible product
70 grams of liquid product
0.25 grams of concentrates (solid or liquid)
1 cannabis plant seed
This means, for example, that an adult 18 years of age or older, can legally possess 150 grams of fresh cannabis.
